Introduction

Welcome to HogLens! These Terms and Conditions ("Terms") govern your use of the HogLens application ("App") and related services, including the HogLens website at www.hoglens.app ("Website").

I am Patrick Diezi, an independent software developer operating under the name KREANIQS, located in Switzerland. By downloading, installing, or using HogLens, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using HogLens, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as my Privacy Policy and End User License Agreement (EULA).

I reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Website or within the App. Your continued use of HogLens after any modifications constitutes acceptance of the updated Terms.

2. Description of Service

HogLens is a native application for macOS (14.0 and later) and iOS (17.0 and later) that provides a dashboard interface for viewing and interacting with PostHog analytics data. The App allows you to:

Connect to PostHog EU Cloud, US Cloud, or self-hosted instances
Create and manage custom dashboards with various chart visualizations
Monitor events in real-time
Synchronize data across your Apple devices via iCloud
Export dashboards and insights as images

HogLens is an independent product and is not affiliated with, endorsed by, or officially connected to PostHog Inc. PostHog is a trademark of PostHog Inc.

3. Account Requirements

3.1 PostHog Account

To use HogLens, you must have a valid PostHog account with an active API token. I do not provide PostHog accounts or API access. You are responsible for maintaining your PostHog account and complying with PostHog's terms of service.

3.2 Apple ID and iCloud

Certain features of HogLens, including cross-device synchronization, require an Apple ID and iCloud account. You are responsible for maintaining your Apple account and complying with Apple's terms of service.

3.3 Age Requirement

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use HogLens. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Subscription and Payments

4.1 Pricing Model

HogLens offers the following purchase options:

Free Trial: 30-day full-featured trial
Monthly Subscription: Recurring monthly payment
Yearly Subscription: Recurring annual payment
Lifetime Purchase: One-time payment for permanent access

All prices are displayed in your local currency through the Apple App Store and may vary by region.

4.2 Billing

All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's terms of service and payment processing. I do not directly collect or process payment information.

4.3 Subscription Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

4.4 Refunds

Refund requests are handled by Apple according to their refund policies. I am unable to process refunds directly. To request a refund, please contact Apple Support or visit reportaproblem.apple.com.

4.5 Family Sharing

HogLens supports Family Sharing, allowing you to share your subscription with up to five family members as permitted by Apple's Family Sharing program.

5. Acceptable Use

5.1 Permitted Use

You may use HogLens for lawful purposes to view and analyze your own PostHog analytics data or data you are authorized to access.

5.2 Prohibited Activities

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to reverse engineer, decompile, or disassemble the App
Circumvent, disable, or interfere with security-related features
Use the App to access data you are not authorized to view
Redistribute, sublicense, or resell the App or any part thereof
Remove, alter, or obscure any proprietary notices or labels
Use automated systems or software to extract data from the App
Interfere with or disrupt the integrity or performance of the App

5.3 API Usage

Your use of the PostHog API through HogLens is subject to PostHog's API usage policies and rate limits. I am not responsible for any issues arising from PostHog API limitations or changes.

6. Intellectual Property

6.1 Ownership

HogLens, including its source code, design, graphics, user interface, and content, is owned by me (Patrick Diezi / KREANIQS) and protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

6.2 License Grant

Subject to these Terms, I grant you a limited, non-exclusive, non-transferable, revocable license to use HogLens on devices you own or control, solely for your personal or internal business purposes.

6.3 Third-Party Components

HogLens incorporates the following open-source components:

MarkdownUI by Guillermo Gonzalez (MIT License)
ZIPFoundation by Thomas Zoechling (MIT License)

These components are used in accordance with their respective licenses, which can be viewed within the App.

6.4 Trademarks

"HogLens" and the HogLens logo are my trademarks. "PostHog" is a trademark of PostHog Inc. Apple, macOS, iOS, iCloud, and App Store are trademarks of Apple Inc. All other trademarks are the property of their respective owners.

7. Your Data

7.1 Your Content

You retain ownership of all data and content you access or create through HogLens, including your dashboard configurations, insights, and analytics data.

7.2 Data Storage

HogLens stores certain data locally on your device and in iCloud (for synchronization). Your PostHog API tokens are stored securely in your device's Keychain and are never transmitted to or stored on my servers. Please refer to my Privacy Policy for detailed information about data handling.

7.3 Data Security

While I implement reasonable security measures, I cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your PostHog API tokens and other credentials.

8. Third-Party Services

8.1 PostHog

HogLens connects to PostHog's servers to retrieve analytics data. Your use of PostHog is governed by PostHog's terms of service and privacy policy. I am not responsible for PostHog's services, availability, or data handling practices.

8.2 Apple Services

HogLens uses Apple services including iCloud (CloudKit) for data synchronization and the App Store for distribution and payments. Your use of these services is governed by Apple's terms and policies.

8.3 No Endorsement

Reference to third-party services does not constitute endorsement. I am not responsible for the content, policies, or practices of any third-party services.

9. Disclaimers

9.1 "As Is" Basis

HOGLENS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2 No Guarantee

I do not warrant that:

The App will meet your specific requirements
The App will be uninterrupted, timely, secure, or error-free
The results obtained from using the App will be accurate or reliable
Any errors in the App will be corrected

9.3 Beta Features

Certain features may be labeled as "Beta" (such as Pie Charts and Number Charts). Beta features are provided for evaluation purposes and may be modified or removed at any time without notice.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I (PATRICK DIEZI / KREANIQS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or alteration of your data
Any third-party conduct or content
Any other matter relating to the App

10.2 Liability Cap

MY TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR CHF 100.00, WHICHEVER IS GREATER.

10.3 Essential Purpose

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Patrick Diezi / KREANIQS from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of HogLens
Your violation of these Terms
Your violation of any third-party rights
Your violation of any applicable laws or regulations

12. Termination

12.1 Termination by You

You may stop using HogLens at any time by uninstalling the App and canceling any active subscriptions through your Apple ID account settings.

12.2 Termination by Me

I may terminate or suspend your access to HogLens at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms or conduct that I believe is harmful to other users or my interests.

12.3 Effect of Termination

Upon termination:

Your license to use HogLens is revoked
You must cease all use of the App
Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any disputes arising from these Terms or your use of HogLens shall be subject to the exclusive jurisdiction of the courts of the Canton of Thurgau, Switzerland.

13.3 Informal Resolution

Before filing any legal claim, you agree to contact me at legal@hoglens.app to attempt to resolve the dispute informally. I will attempt to resolve the dispute by contacting you via email within 30 days.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and EULA, constitute the entire agreement between you and me regarding HogLens and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

My failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without my prior written consent. I may assign these Terms without restriction.

14.5 Language

These Terms are written in English. Any translations are provided for convenience only, and the English version shall prevail in case of any discrepancy.
