IMPORTANT — PLEASE READ CAREFULLY

This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User," "you," or "your") and Patrick Diezi, operating under the name KREANIQS ("Licensor," "I," "me," or "my"), for the use of the HogLens software application ("App" or "Software").

BY DOWNLOADING, INSTALLING, OR USING HOGLENS, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.

1. Definitions

"App" or "Software" means the HogLens application, including all updates, upgrades, modifications, enhancements, revisions, new releases, and any associated documentation.

"Device" means a compatible Apple computer (Mac) or mobile device (iPhone, iPad) on which the App can be installed and operated.

"License" means the rights granted to you under this EULA.

"Licensor" means Patrick Diezi, operating as KREANIQS.

"Third-Party Services" means services provided by entities other than the Licensor, including but not limited to PostHog and Apple.

2. License Grant

2.1 Grant of License

Subject to the terms of this EULA and payment of applicable fees (if any), I hereby grant you a limited, non-exclusive, non-transferable, revocable license to:

a) Download and install the App on Devices that you own or control;

b) Use the App for your personal or internal business purposes;

c) Use the App in accordance with Apple's Usage Rules set forth in the App Store Terms of Service.

2.2 Scope of License

This License is granted for:

macOS: Version 14.0 (Sonoma) or later
iOS: Version 17.0 or later

The License applies to all versions of the App, including updates provided under your subscription or purchase.

2.3 Family Sharing

If you obtained the App through Apple's Family Sharing feature, you acknowledge that the organizer of your Family Sharing group has accepted this EULA on behalf of family members, and all family members must comply with these terms.

3. License Restrictions

You agree NOT to, and shall not permit any third party to:

3.1 Modification and Derivative Works

Modify, adapt, translate, or create derivative works based on the App
Alter, remove, or obscure any proprietary notices, labels, or marks

3.2 Reverse Engineering

Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive the source code of the App
Attempt to bypass, disable, or circumvent any security measures, technological protection measures, or copy protection mechanisms

3.3 Distribution and Transfer

Distribute, sublicense, lease, rent, loan, or otherwise transfer the App or any rights therein to any third party
Make the App available over a network where it could be used by multiple devices at the same time (except via your authorized iCloud sync)
Publish, copy, or reproduce the App for public or commercial distribution

3.4 Harmful Use

Use the App for any unlawful, harmful, or fraudulent purpose
Use the App to infringe upon the rights of others
Use the App to transmit viruses, malware, or other harmful code
Use the App to access systems or data without authorization

3.5 Commercial Exploitation

Use the App to develop a competing product or service
Use the App for any commercial purpose not expressly permitted by this EULA

4. Subscription and Purchase Terms

4.1 Purchase Options

HogLens is available through the following purchase options:

Lifetime Purchase	One-time payment for permanent access

4.2 Payment Processing

All payments are processed by Apple through the App Store. I do not collect or store your payment information. Your purchase is subject to Apple's terms and conditions.

4.3 Subscription Terms

Automatic Renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.

Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.

Price Changes: I reserve the right to change subscription prices. Any price changes will apply to the next billing period following notice of the change.

4.4 Trial Period

The 30-day free trial provides access to all features. At the end of the trial:

If you do not purchase, your access to premium features will be restricted
Your data will remain on your device and in iCloud
You may purchase at any time to restore full access

4.5 Refunds

Refund requests must be directed to Apple. I am unable to process refunds directly. Please visit reportaproblem.apple.com or contact Apple Support.

5. Intellectual Property Rights

5.1 Ownership

The App, including all copies, modifications, enhancements, and derivative works thereof, and all intellectual property rights therein, are and shall remain the exclusive property of Patrick Diezi / KREANIQS.

This EULA does not grant you any ownership interest in or to the App, but only a limited right of use revocable in accordance with this EULA.

5.2 Copyright

The App is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The App is licensed, not sold.

5.3 Trademarks

"HogLens" and any associated logos are trademarks of Patrick Diezi / KREANIQS. This EULA does not grant you any right to use such trademarks.

5.4 Third-Party Components

The App includes the following third-party open-source components:

These components are subject to their respective licenses, which are included in the App.

5.5 Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by me without any obligation to you. By submitting feedback, you grant me a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback.

6. Privacy and Data

6.1 Privacy Policy

Your use of the App is also governed by my Privacy Policy, which is incorporated into this EULA by reference.

6.2 Data Collection

HogLens does not collect, store, or transmit your personal data to my servers. The App operates as a client-side application connecting directly to your PostHog server.

6.3 Data Storage

API Tokens: Stored securely in your device's Keychain (not synced to cloud)
App Data: Stored locally using SwiftData and optionally synced via iCloud
Cache: Temporary data stored locally for performance

6.4 Third-Party Data Processing

The App communicates with:

PostHog: To retrieve your analytics data
Apple iCloud: To synchronize your app data across devices
Apple App Store: For purchases and entitlement verification

Your interactions with these services are governed by their respective privacy policies and terms.

7. Third-Party Services

7.1 PostHog

HogLens is designed to work with PostHog analytics services. You must have a valid PostHog account and API token to use the App's core functionality.

Disclaimer: HogLens is an independent product and is not affiliated with, endorsed by, sponsored by, or officially connected to PostHog Inc. in any way. "PostHog" is a trademark of PostHog Inc.

Your use of PostHog is subject to PostHog's terms of service and privacy policy.

7.2 Apple Services

The App utilizes Apple services including:

App Store: For distribution and purchases
iCloud (CloudKit): For data synchronization
Keychain: For secure credential storage
StoreKit: For in-app purchases

Your use of these services is subject to Apple's terms and conditions.

7.3 No Third-Party Liability

I am not responsible for the availability, functionality, or policies of third-party services. Any issues with third-party services should be directed to the respective service provider.

8. Updates and Modifications

8.1 Software Updates

I may, from time to time, release updates to the App. Updates may include bug fixes, feature enhancements, security patches, or other modifications.

8.2 Automatic Updates

If you have enabled automatic updates on your device, updates may be downloaded and installed automatically. You agree that I may automatically download and install updates.

8.3 Update Requirements

Some updates may require you to accept new terms or may change the functionality of the App. If you do not agree to updated terms, you may discontinue use of the App.

8.4 Discontinuation

I reserve the right to discontinue or modify the App at any time. I will make reasonable efforts to provide notice of any discontinuation but am not obligated to do so.

9. Support and Maintenance

9.1 Support

I provide support for the App through:

Support is provided on a reasonable-efforts basis and is not guaranteed.

9.2 No Maintenance Obligation

Unless otherwise required by applicable law, I am not obligated to provide maintenance, technical support, or updates for the App.

10. Disclaimer of Warranties

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

10.2 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

a) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT;

b) WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE;

c) WARRANTIES THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS;

d) WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;

e) WARRANTIES THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED;

f) WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY RESULTS OR INFORMATION OBTAINED THROUGH THE APP.

10.3 Beta Features

Certain features of the App may be designated as "Beta" (including but not limited to Pie Charts and Number Charts). Beta features are provided for evaluation purposes only and are provided "as is" without any warranties. Beta features may be modified, suspended, or removed at any time without notice.

10.4 Third-Party Services

I DO NOT WARRANT THE AVAILABILITY, ACCURACY, OR RELIABILITY OF ANY THIRD-PARTY SERVICES, INCLUDING POSTHOG AND APPLE SERVICES.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL I (PATRICK DIEZI / KREANIQS) BE LIABLE FOR ANY:

a) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;

b) LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES;

c) LOSS OF DATA OR DATA CORRUPTION;

d) LOSS OF GOODWILL OR REPUTATION;

e) COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES;

f) ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP;

REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.2 Maximum Liability

MY TOTAL CUMULATIVE LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE GREATER OF:

a) THE AMOUNT YOU ACTUALLY PAID FOR THE APP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR

b) ONE HUNDRED SWISS FRANCS (CHF 100.00).

11.3 Essential Purpose

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

11.4 Jurisdictional Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES OR OTHER LIMITATIONS. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

12. Indemnification

You agree to indemnify, defend, and hold harmless Patrick Diezi / KREANIQS, and any affiliates, officers, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

a) Your use of the App;

b) Your violation of this EULA;

c) Your violation of any third-party rights, including intellectual property rights;

d) Your violation of any applicable laws or regulations;

e) Any content or data you transmit through the App.

13. Term and Termination

13.1 Term

This EULA is effective from the date you first download, install, or use the App and continues until terminated.

13.2 Termination by You

You may terminate this EULA at any time by:

Uninstalling and deleting all copies of the App from your Devices
Canceling any active subscription through your Apple ID settings

13.3 Termination by Licensor

I may terminate this EULA immediately, with or without notice, if:

a) You breach any term of this EULA;

b) You engage in fraudulent, illegal, or harmful conduct;

c) Required by law or legal process;

d) I discontinue the App.

13.4 Effect of Termination

Upon termination:

a) All rights granted to you under this EULA will immediately cease;

b) You must cease all use of the App;

c) You must delete all copies of the App from your Devices;

d) The following provisions will survive termination: Sections 5 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law).

13.5 Data After Termination

Your locally stored data will remain on your device until you delete the App. Your iCloud data will remain until you delete it through Apple's settings.

14. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and sanctions programs maintained by OFAC. You represent that you are not located in, under the control of, or a national or resident of any country subject to applicable trade sanctions.

15. Governing Law and Dispute Resolution

15.1 Governing Law

This EULA shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of laws principles.

15.2 Jurisdiction

Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of the Canton of Thurgau, Switzerland.

15.3 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact me at legal@hoglens.app to attempt to resolve the dispute informally. I will attempt to resolve the matter within 30 days.

16. Apple-Specific Terms

This EULA incorporates by reference the Licensed Application End User License Agreement published by Apple at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

16.1 Acknowledgment

You acknowledge that this EULA is between you and Patrick Diezi / KREANIQS, not Apple. I, not Apple, am solely responsible for the App and its content.

16.2 Scope of License

The license granted is limited to a non-transferable license to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.

16.3 Maintenance and Support

I am solely responsible for providing any maintenance and support services for the App. Apple has no obligation to provide any maintenance or support.

16.4 Warranty

I am solely responsible for any product warranties. In the event of any failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation.

16.5 Product Claims

I, not Apple, am responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection laws.

16.6 Intellectual Property Claims

I, not Apple, am responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claims.

16.7 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right to enforce this EULA against you.

16.8 Legal Compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government prohibited or restricted parties list.

17. General Provisions

17.1 Entire Agreement

This EULA, together with the Privacy Policy and Terms and Conditions, constitutes the entire agreement between you and me regarding the App and supersedes all prior agreements and understandings.

17.2 Amendment

I reserve the right to modify this EULA at any time. Changes will be effective upon posting to the Website or within the App. Your continued use of the App after any changes constitutes acceptance of the modified EULA.

17.3 Severability

If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.4 Waiver

My failure to enforce any provision of this EULA shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless in writing and signed by me.

17.5 Assignment

You may not assign or transfer this EULA or any rights hereunder without my prior written consent. I may assign this EULA without restriction.

17.6 Language

This EULA is written in English. Any translations are provided for convenience only. In case of any conflict between the English version and any translation, the English version shall prevail.

17.7 Headings

Section headings are for convenience only and shall not affect the interpretation of this EULA.

17.8 No Agency

Nothing in this EULA creates any agency, partnership, joint venture, or employment relationship between you and me.
